Visa refused?
Visa Refused in Australia? Your Options
A refusal is not always the end. Understand why your visa was refused, whether you can apply for review, and the other pathways that may still be open to you.
Understanding Your Visa Refusal
Only the Minister or a delegate can grant, refuse or cancel a visa. If your application is refused, your decision letter explains the reasons and whether you have a right to review, who can apply and the time limit.
Your options depend on the visa, the reasons for refusal and whether you are in Australia. Common options include ART review, a new application that addresses the problems, or a different visa pathway. A refusal can also affect future applications, so it is important to get advice before you act.
Act quickly: time limits are strict
Time limits for ART review are very strict. They depend on the type of decision and whether you are in immigration detention, and your time limit is set out in your Department of Home Affairs decision letter. The tribunal has no power to extend the time limit, so contact us as soon as you receive a decision.
Your Options After a Refusal
If you have review rights, apply to the Administrative Review Tribunal within the time limit.
If the problems can be fixed, a new application with stronger evidence may be better. Some people in Australia face limits on further applications after a refusal.
A different visa may suit your circumstances better. We can assess your eligibility across all visa types.
After a refusal, check whether you hold a bridging visa and what its conditions are. Staying in Australia without a valid visa has serious consequences.
